Terms of Use

These terms are an agreement between you and Qer.ai (“Qer.ai”, “we”, “us”). They apply when you use qer.ai and app.qer.ai (the “Service”). By creating an account or using the Service you accept them. If you use the Service for a company, you confirm you can bind that company, and “you” includes it.

1. The Service

Qer.ai tracks how third-party AI engines and search products answer prompts about your brand, competitors and market, and presents the answers, sources, sentiment and rankings. Features and limits depend on your plan.

2. Your account

You must give accurate information, keep your password secure and tell us promptly about any unauthorized use. You are responsible for activity under your account and for the people you invite to your workspace. You must be at least 18.

3. Free check and free trial

The free check lets you see a first result without a credit card. A free trial lets you use the Service without charge for the trial period shown at sign-up, and needs no payment details. When the trial ends, tracking pauses until you choose a paid plan; we do not charge you automatically. We keep your workspace for a limited time so you can subscribe later. We may limit free checks and trials per person or company, and may refuse or end them where we suspect abuse.

4. Subscriptions, billing and taxes

• Billing: plans are billed in advance, monthly or yearly, in US dollars through Stripe. Prices are shown before applicable taxes, such as GST and QST, which we add where required.
• Renewal: subscriptions renew automatically until cancelled.
• Cancellation: you can cancel at any time in the app. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Refunds: fees are non-refundable except where the law requires it or where we say otherwise in writing.
• Changes to price: we will give you at least 30 days’ notice before a price change applies to you.
• Late payment: if a payment fails, we may pause tracking until it is resolved.

5. Acceptable use

You agree not to:

• break the law or infringe anyone’s rights;
• attempt to disrupt, overload or probe the Service, or bypass plan limits, rate limits or security controls;
• scrape, resell or republish the Service or its data except as your plan allows;
• use the Service to build a competing product;
• upload malicious code, or misuse another person’s account.

We may suspend accounts that breach this section.

6. Your content

You keep ownership of the content you add, such as brand names, websites and prompts. You give us a licence to store and process it to provide the Service. You confirm you have the right to add it.

7. Our property

Qer.ai, its software, design and documentation belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. The reports and data you export are yours to use for your own business.

8. AI outputs and third-party platforms

The answers we show come from third-party AI engines and search products. They can vary from run to run, from place to place and over time, and they may be incomplete or wrong. We report what those services return and do not control or guarantee it. Qer.ai is not affiliated with, or endorsed by, OpenAI, Google, Microsoft, Perplexity, Anthropic, xAI or any other platform we track. Their names and marks belong to their owners.

9. Availability and changes

We work to keep the Service available but do not promise uninterrupted or error-free operation. We may change, add or remove features, and may update these terms. If a change is material, we will give notice by email or in the app before it applies. If you keep using the Service after the effective date, you accept the update.

10. Termination

You can stop using the Service and close your account at any time. We may suspend or end your access if you breach these terms, if payment fails, or if we must by law. On termination we will make your data available for a reasonable period, then delete it as described in our Privacy Policy.

11. Disclaimer

The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and non-infringement. We do not promise that using the Service will improve your visibility, rankings or revenue.

12. Limitation of liability

To the extent the law allows, Qer.ai will not be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the event that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law, including for intentional or gross fault or for bodily or moral injury.

13. Governing law

These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. The courts of the judicial district of Montréal have exclusive jurisdiction, except where the law gives you the right to bring a claim elsewhere.

14. Language

The parties have expressly required that this agreement and all related documents be drawn up in English. Les parties ont expressément exigé que la présente convention et tous les documents connexes soient rédigés en anglais.

15. General

If part of these terms is found unenforceable, the rest stays in force. Our not enforcing a right is not a waiver of it. You may not transfer your rights under these terms without our consent. These terms and our Privacy Policy are the whole agreement between us about the Service.
